By creating an account or using this service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms of Service ("Terms") govern your access to and use of byesu.com and its related subdomains, interfaces, and APIs (collectively, the "Service").
1. What the Service Is
The Service is an API gateway — an aggregation/proxy layer for third-party AI model APIs. We are not the developer or official operator of the underlying models; their capabilities, versions, and availability are controlled by upstream providers and may change without notice. We describe models in good faith and do not knowingly substitute lower-grade models for advertised ones.
2. Eligibility and Regions
You must be at least 18 years old and legally able to enter into a contract. The Service is not available in mainland China, nor in any jurisdiction under comprehensive sanctions or where use would breach applicable law or our upstream providers' restrictions. See Supported Regions for details.
3. Accounts and API Keys
You are responsible for safeguarding your credentials and API keys and for all activity under your account, including activity by anyone to whom you make your keys available. Report any leak or anomaly to us immediately at bysu721@gmail.com and rotate your keys.
4. Fees, Balance, and Refunds
The Service operates on a prepaid, usage-based model; the prices and the actual rate multiplier of your group shown at checkout govern. Your account balance and credits are prepaid usage allowances only — not a deposit or stored-value account — carry no cash value, and do not accrue interest. Promotional or complimentary credits likewise have no cash value and are non-refundable.
Consumed digital usage is generally non-refundable except where required by law. Refund details — including automatic refunds for failed video generation tasks, how billing for unsuccessfully processed requests is reviewed, and case-by-case handling of unused balance — are set out in the Refund Policy.
5. Privacy and Data
We log only the metadata needed to run, secure, and bill the Service. We do not sell your data and do not use your content to train models. We apply encryption in transit and access controls. Please redact secrets and sensitive personal data before submitting. See the Privacy Policy for details.
6. International Processing
Because models may be operated outside your country, your requests may be processed and transferred internationally, including to third-party model providers. By using such models you consent to this transfer. EU/EEA, UK, and California users have the rights described in the Privacy Policy.
7. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied. Unless expressly agreed in a separate written agreement, we do not offer a service level agreement (SLA) or uptime guarantee; upstream providers may experience outages, deprecate models, or change behavior at any time, and such changes are outside our control. AI output may be inaccurate or "hallucinated" and does not constitute professional (medical, legal, financial, etc.) advice; verify before relying on it. Decisions made in reliance on output are at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total aggregate liability will not exceed the greater of the fees you paid in the prior three (3) months or USD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You will indemnify us against claims and losses arising from your use of the Service, your content, or your breach of these Terms or the law.
10. Suspension and Termination
We may warn, rate-limit, suspend, or terminate accounts that violate these Terms, the Acceptable Use Policy, the law, or upstream provider policies, and may report unlawful activity to the relevant authorities. You may stop using the Service at any time and may request account closure via bysu721@gmail.com. Treatment of any remaining balance on suspension or termination is described in the Refund Policy.
11. Changes and Governing Law
We may update these Terms from time to time; material changes will be announced on the Service or via the contact information on your account before they take effect, and continued use after the effective date is acceptance. These Terms are governed by the laws of the operator's place of establishment; disputes are resolved by the competent courts or arbitration body at that place.
12. Agreement Structure and Order of Precedence
These Terms, together with the Acceptable Use Policy, the Service-Specific Terms, the Privacy Policy, the Refund Policy, and Supported Regions, form the agreement between you and us regarding the Service, each incorporated into these Terms by reference. If these Terms conflict with a dedicated policy on a matter that policy specifically governs, the dedicated policy prevails.
13. General Provisions
Entire agreement. The agreement described in Section 12 constitutes the entire agreement between you and us regarding the Service and supersedes any prior oral or written communications or agreements on the same subject.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the affected provision will be enforced to the maximum extent permitted in a manner closest to its original intent.
Force majeure. We are not liable for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, war, government action, power or network outages, and large-scale upstream provider failures.
No waiver. Our failure or delay in exercising any right under these Terms is not a waiver of that right, and a single waiver does not constitute a continuing waiver of subsequent breaches.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, or transfer of assets, and will provide reasonable notice.
